Background on Pembina Chippewa
Membership Roll Creation
The Enabling Act of 1889 enacted February 22, 1889 laid the foundation for the United States intention to convert the Dakota Territory into U.S. States. At the time, the United States had purchased lands of the Sioux, Mandan, Sisseton, Wahpeton, Arikara, and Hidatsa Indian Nations within the Dakota Territory. However, they had not yet obtained Pembina Chippewa Lands of the Great Chippewa Nation.
On August 19, 1889 the United States issued the Indian Appropriation Act and organized a three person commission to negotiate with the Pembina to purchase their lands. However by October 1889 they had failed. Believing that eventually they would persuade the Pembina Chippewa at some point On November 2, 1889 the United States included Pembina Chippewa lands within the stated boundaries of the newly created state of North Dakota.
From November of 1889 until January of 1891 the United States commission continued in their efforts to convince the Pembina Chippewa to sell their lands, however, the United States inclusion of their ancestral lands and the United States actions of illegally selling or issuing their lands to American settlers created an impasse.
Amidst this, the United States Indian Agents had began encouraging large amounts of Canadian Cree and Sioux to populate the Turtle Mountain Indian Reservation, another illegal creation of the United States in 1882. In addition, Indian Agents and the commission threatened to replace the Chief and his Grand Council if they did not agree to sell. Feeling disrespected, Chief Little Shell III, Chief Red Bear and the Grand Council, all signatories of the 1863 Old Crossing Treaty, refused to sell.
On January 7, 1891, the Little Shell Pembina Chippewa Nation issued a statement (signed by all authorized agents of the Tribe) to the United States President declaring their unceded land boundaries, the illegality of the extension of Fort Berthold boundaries into their Pembina Chippewa Lands, that the United States President cease the issuance of Pembina Chippewa Lands for white settlement as they have never been ceded, that the United States cease illegally harming Pembina Chippewa Timber lands, that Pembina tribal member J.B. Bottineau will serve as authorized Tribal Attorney and agent with the United States Government, and that only Chief Little Shell and his Grand Council had the authority to cede their land title rights and that Treaty was the only authorized means to obtain such, which they to date have never done.
The following month, on February of 1891, the Commission organized in August of 1889 to purchase lands before the state was created, closed their commission and stated:
“None of the objects for which the commission was established was accomplished by it”
Additionally, due to threats from the United States to organize new councils in order to obtain the land, albeit illegally, the Pembina Chippewa released the signatures of all male members at the time. This is considered the first roll and is listed below as well as each additional role.
In September of 1892 the United States Government would organize a Council of 32 of non-Pembina Chippewa members, and following the final refusal of Chief Little Shell III to sell his nation in October of 1892, the United States used this illegal Council to sign the McCumber Agreement.
Despite actual original signatories of the 1863 Old Crossing Treaty being alive, and in fact the entire of Little Shell III’s Grand Council having signed it, the United States Government hastily did whatever they could to validate their illegal use of Pembina Chippewa lands in the creation of the state of North Dakota.
As people lived vast distances and traveled by foot or on horse to sign with the Chief and Grand Council, and could not attend every occurrence, but did attend at least 1 occurrence. Therefore, the rolls of 1891, 1892 and 1893 collectively are the first roll of the Pembina Chippewa Nation.
